By accessing and using this Client Gallery (“Gallery”), you (“Client”) agree to the following terms and conditions as set forth by Nick Sparkman (“Photographer”):
1. Purpose of Gallery Access
The Gallery is provided solely for Client’s personal use in connection with the proofing, selection, and/or final delivery of images from the commissioned photography session. Access to the Gallery does not transfer any ownership or copyright in the images.
2. Download Access
Download permissions may vary depending on the nature of the service provided.
Proofing galleries are typically delivered in watermarked or low-resolution format for selection purposes only and are not intended for public use, sharing, or distribution.
Final high-resolution, non-watermarked images may be made available for download upon full payment of all fees as outlined in the client’s agreement.
Unauthorized downloading, screenshotting, or reproduction of proofs or unfinished work is strictly prohibited.
3. Gallery Availability
Galleries will remain available online for a period of 60 days from the date of delivery, unless otherwise specified in writing. It is the Client’s responsibility to download and securely store final images prior to gallery expiration.
Requests for reactivation or re-hosting of expired galleries will be subject to a re-hosting fee of $40 and are subject to Photographer’s availability and discretion.
4. Sharing and Third-Party Access
Gallery access is provided exclusively to the Client. Sharing of gallery login credentials, download links, or access with any third parties (including vendors, publishers, or commercial entities) without prior written consent from the Photographer is strictly prohibited.
5. Image Usage Restrictions
All images within the Gallery remain protected by copyright law.
Images provided in proofing galleries may not be used for personal or commercial purposes until final, fully delivered versions are provided by the Photographer.
Upon delivery of final images, personal-use licensing terms apply as outlined separately in the Digital Image License.
Commercial use of any image requires a separate, written licensing agreement.
6. Modification of Images
Client agrees not to alter, edit, crop, apply filters, or modify images in any way that may compromise the integrity of the Photographer’s work, unless otherwise authorized in writing.
7. Limitation of Liability
The Photographer shall not be held liable for temporary unavailability of the Gallery platform due to maintenance, technical failure, or any cause beyond reasonable control.
